Legal Question in Criminal Law in California
Restitution
My employee confessed to embezelling from me, was convicted of 2 felony counts, spent 6 months in jail and is now out ordered to pay full restitution by the end of 5 years probation. Many months have passed and I hear she's paying back her mother for bail money put up but I've seen nothing. Is a payment schedule enforceable? I'm desperate for something to be coming back on the nearly $50,000 she still owes. It would seem to me that a victim should be paid before her family member.

I agree with Terry, call the prosecuting attorney/DA. It is grounds to have the Probation revoked. Think of her Probation as a contract with the State to make payments to you in exchange for early release. She is currently in breach.
