Legal Question in Criminal Law in California
restraining order
my wife and i are in a seperate custody dispute to get custody of our daughter after she was taken for alleged abuse by child services. The child is in the custody of my parents.
My wife left the relationship and has filed a restraining order for domestic abuse of her and minor children.
There has never been evidense to support abuse of any kind to either my wife or child and police have never been involved or charges filed?
What rights do I have to oppose or dissolve this restraining order? I want to see my child.

Re: restraining order
You need to retain an attorney to help you in the defense of this claim. A temporary restraining order expires on the date set for the hearing on the permanent restraining order. If there is no evidence you shoulod be able to defeat her request for a restraining order.
