Legal Question in Criminal Law in California
Retraining order
How can I find out if I have a
restraining order filed against me
and it hasn't been served yet? Is
the weekend considered part of
the 5 days before the hearing? Is
the person filing suppose to call?

Re: Retraining order
If you have reason to suspect it, you should assume it has been. You can go to the court and check the 'defendant' index for your name. It is not unheard of that people falsely claim to the court that the papers were served when they actually haven't been, in order to get the hearing to go by default. If you decide to hire counsel to help you, feel free to contact me.
