Legal Question in Criminal Law in California

Retrieving Stolen Money

Hello

Over the past 2 1/2 years a neighbor and personal friend has been paying his bills using my checking account number. He has coached my son through out these years and I have paid him to do so with personal checks. He has paid his bills with over $12,000 of my money. The bank will probably return $750.00 as I am protected for the past 60 days. I have filed a claim of fraud with my bank but I would like to know would there be anyway of re-couping my money from him?

Re: Retrieving Stolen Money

There are two in ways in which you could get your money back. First is via what is called criminal restitution which would apply if your friend was convicted in criminal court and the judge would order him/her to repay the damage. The other option would be to sue your friend in a civil court which would require you to get your own lawyer.

By civil lawsuit if he doesn't do so voluntarily, or by you filing criminal charges and getting restitution. If you need legal help, and if you are in SoCal, feel free to contact me.

Re: Retrieving Stolen Money

Easy enough. Have him prosecuted for this, and the court will order him to pay you back in full as a condition of not going to prison.
