Legal Question in Criminal Law in California
Scope of search
I was pulled over and arrested for a DUI drugs. After searching and not finding anything in my car, since I was on probation, the police took me to my residence and then searched my home under the guise of a probation search. My question is to the legality of them taking me home to search my house. Isn't there a reasonable-ness clause to probation searches?

You waved your rights to object to search and seizure when you accepted probation instead of jail on your original conviction.
