Legal Question in Criminal Law in California

sealed records

At the age of 18 (in 1971) I was arrested for shoplifting a pair of pants in California. I was in jail for about 30 days, and was told my record would be sealed at the age of 21. Is this information still available to employers who do fingerprinting?

Re: sealed records

Potentially, yes, even though juvenile records are supposed to be confidential. But, if you want to actually expunge the record and get the conviction set aside and dismissed, so you can legally say 'no' on applications asking about convictions, there is a procedure of application to the court. Contact me if interested in doing so.

I defer to the opinions of others as to whether or not an employer could learn of your conviction. However, I believe you could confess the entire situation to anyone and suffer no negative consequences. It was a LONG time ago and your honesty will earn you credibility.
