Search Warrant

Basic Questions: 1. In the state of california, what must be demostrated to the court to show probable cause in issuing a search warrant? 2. Is there a formal way that the above is show to the judge, rather than words written on a paper napkin with signatures on the bottom? 3. As a person being served the warrant, am I to have a formal document(copy or original) presented to me... with ''I swear...'', dates & time, court stuff, what is planned to be confincated, and proper signature? (again, not a single line, color picture inserted, two page word document with two signatures)

I am not 100% innocent, but on the other hand I do not deserved the crap that they have given me.

1. My public defender was a woman carring a wedding dress book and was intrested in the book than to do cases that day.

2. She advise me to plead guilty so that I get out of jail in 27 days or so. 104 days later I was released. Nobody told me about the 90 days that they imposed.

3. I told her that I thought the warrant was not right. She blew me off. Public Def in this district served the intrest of the DA rather that the defendant.

Please help me!!!

The only thing that is going to help you is not an anonymous free opinion, but a suggestion to get another attorney if you are not happy with the current one. What would you do with a legal opinion anyway, not knowing how to use it?

First of all that was the worse thing you did was to get a public defender. They don�t care about their work; they only do it because they have to. I can not explain the things about the search warrant because it is way too complicated but I highly advise you to contact our law office first thing Monday morning so we can discuss this further. 760.243.5121
