Legal Question in Criminal Law in California
Seeking advice for a criminal case
My boyfriend was arrested for Burglary and Receiving Stolen Property. He was in someone else's vehicle when they were pulled over for a traffic stop. The person driving the vehicle was also arrested for the same charges. I believe stolen items were recovered from the vehicle, and since the officer didn't know who stole them, he charged them both. My question is, what are the chances that both people will be convicted for this? I thought if stolen items were found in a vehicle, the owner of the vehicle and/or the person driving would be charged- not the passenger. Both people have priors, and the driver is fighting another burglary case in a different county as we speak. Any advice would be appreciated. Thanks

Advice? Get an attorney, unless he likes prison. Just what do you believe you will do with any hints and tips received on this site? You can't print them out and waive them at the judge from the court audience section. This case has to be defended with whatever facts, evidence. law, procedures and arguments that competent counsel can gather and submit in court.
