Legal Question in Criminal Law in California
sentencing for violating probation PC 532(a)
My son's probation should expire 6-10-2006, but was violated for non-payment of his fines. The payments are deducted from his paycheck and sent to financial services where they apply to fines. They have never applied any funds to booking fees, probation dept reimbursement or admin court fees, all is applied to victim restitution. Can he give direction as to where funds should be applied? Also he violated probation for having a lap top computer that had internet access.(he used it for work related technician stuff) When he goes to court what are the chances of his arrest? and for how long? would bail be an option? This is his first time in any serious trouble, he has a very good job now and small children to take care of. Someone (do not know who) told him to expect prision time for at least one year. He would not last one week in there. Is there any way to know what to expect at court?

There are no guarantees about outcome, but your 'friend' was way off base saying a year. If he has been paying regularly in good faith, and this is only a small glitch, a good attorney should be able to convince the court to simply continue the probation order until completed, without jail time.
