Legal Question in Criminal Law in California

From sexual harrasment to child molestation

Afriend of mine was placed in jail because on his way to the restroom of a store he bumped into a lady. He and the lady both excused themselves. When he came out of the restroom he had cops waiting for him. When he got questioned they said thatit was for sexual harrasment. When we went to court the charges were child molestation and lewd and lascivious act on a child (both misdeamenor). An attorney that I talked to said that if a person touches an adult thinking that it was a child he is guilty of child molestation. Being that this happened at Target we thought that they were going to get the video and everything was going to be fine. It didn't. We know that he is not guilty because he only bumped into the lady. He did not touch her in any sexual way for any period of time but we can't afford an attorney. We would appreciate any advise.

Assuming the case will be with the public defender , they, as counsel for the accused, can subpoena the tape which may explain some things, though generally, these tape sare secured by teh store and or police at the time of the events in question. I'm sure they can also have any witnesses interviewed. There are many fine Public Defenders. Make sure they get the info.
