Legal Question in Criminal Law in California
shooting inside the house
My husband was arrested with 246.3pc code, and he is bailed out now and waiting for the court date. He shot inside our house and nobody at home while he was shooting. Will he be charge in the jail or just have some classes/community services? Can he get the police report from police station?
Do you think he representative himself or hire someone else better?

He faces a year in jail if convicted, you decide whether he is competent to defend himself in court. If this is in SoCal, and he gets serious about hiring counsel, feel free to contact me.

Representing yourself in a criminal case is ALWAYS a terrible idea. Your husband needs to get a lawyer involved as soon as absolutely possible. If he cannot afford private counsel, he should be entitled to services by a public defender.

Negligent discharge of a firearm (PC 246.3) can be either a felony or a misdemeanor, depending on what level of negligence the DA feels is present. Whenever there are guns involved, the DA usually looks for jail time, but it depends on what county and a few other factors.
