Shoplifting
My son was caught shoplifting and the police were not involved. We received a letter from the stores attorney and we need to pay $375. If we don't pay what will happen.

They will contact the city attorney and request petty larceny charges be filed. Pay the money, it's the easiest resolution for you.

Criminal charges will be filed against him. However, they will be filed even if you pay; surprise! That's the dirty secret of this issue. Hire an attorney to help you.

Chances are criminal charges will be filed whether you pay or not. Some people believe that there is a slight chance the store will not press charges if you pay. Paying might be a good idea because it would help to get a better resolution to the criminal case. If there is a case, get a lawyer.

If you don't pay, they will likely take the matter to the police and ask that he be prosecuted. The problem is: if you DO pay, they can do it anyway. It would be better if you could talk directly with them and ask if it is their intention to let it go unprosecuted if you pay.
You see, paying could be evidence of consciousness of guilt. It's gamble. You need more info, as I mentioned. Do NOT let your son make the call.

If you do pay the fine, get them to agree that they will not elect to press charges against you and that if charges are filed, they will enter into a civil compromise to help get them dropped.
I would recommend hiring an attorney to help you with this matter.
Most of the time, paying what they request does NOTHING to help you with a criminal matter.
