Legal Question in Criminal Law in California
shoplifting
a little over three weeks ago I was
cought for stealing a bathing suit. I
had never been in any kind of
trouble before and was very
cooperative. unfortunately the cops
came and arrested me and I was let
go 6 hours later..now I have recieved
a letter from the stores lawyer and
he wants four houndred dollars
before the court date. is that
considered settling out of court? can
I get in trouble if I dont pay that? or
should I just wait to see if the judge
will lower it?

The judge has nothing to do with how much the store demands. Understand though, that a payment to the store does NOT prevent them from continuing the criminal case against you; it is common for them to do so. You need to have an attorney negotiate a written agreement that waives prosecution. Feel free to contact me if serious about doing so.
