Legal Question in Criminal Law in California
shoplifting
my 14 year old son was caught trying to steal a $12.00 hat from Mervyns. I was call to pick him up. I just received a letter from an attorney that represents Mervyns stating I have 30 days to pay $295.00 or face litigation. Is this legal? Wouldn't it be better to have the police deal with this instead of Mervyns security ?

Legal? Of course. You should hope that if you pay the 'costs' they ask, they won't also file criminal charges. They can do both. If he is arrested, feel free to contact me for legal defense, if the case is in SoCal courts.
