Legal Question in Criminal Law in California

My son and his friend was picked up for shoplifting a bottle of vodka and detailed by lost prevention officers and asked them questions. The kids told them that they didn't want to talk without a parent. At that time the police were called. The police read them their rights and asked if they understood, my son told them that no he didn't and that he didnt want to talk without a adult, but being confuse he tried to explain. Doesn't the police officer have to stop and wait for a adult to be present. Because he was confuse he ended up talking to the police and arrested for Burglary.

Get him an attorney, better late than never. Whatever confession he gave by being 'cooperative' will have to be dealt with by the attorney.

I agree with Mr. Nelson. He probably would have been arrested whether he spoke to the police or not. However, the "confession" only hurts his case. You need to get someone in your area who knows how to deal with the situation.
