Legal Question in Criminal Law in California
My son is on probation and was ordered to take an AOD Class. He made through 6 months but then missed 3 classes during Thanksgiving. Says he thought they were off during Holiday! DUMB! Anyway he went back to class and they said he was kicked out. He went to see his probation office and they violated him. PO said he was sorry, but he had to do that. PO said he likes him very much and he has always been respectful. My question is this a very bad violation? How long do you think he will get in jail?
1 Answer from Attorneys
He will possibly get up to the remaining 'time' that was originally ordered, if the court wants to fully punish him for the violation. His attorney should be seeking 'reduced penalties' for the violation and reinstatement of probation and the class / program.
