Legal Question in Criminal Law in California
My son was threatened by a man who took a hammer to his door knocking holes in it and kicking it in telling my son he was going to f#ck him up! Coming at my son he tripped on part of the door in fear of his life my son took the hammer from him and natural instint hit him twice in the head! My son called 911 ask for an ambulance and told the operator what had happened! When the police got there they arrested my son! I've got pictures of the door showing without any doubt the it was broken in but yet they arrested my son why? What can I do?

I can only say that it seems that law enforcement did not believe your depiction of the facts. The one thing I'm sure of though is that, if you can afford it, get your son a very qualified attorney ASAP..... David Wallin

When threatened, arrested or charged with any crime, �What can you do�? Hire an attorney, unless you know how to effectively represent yourself in court against a professional prosecutor intending to convict. No amount of free 'tips and hints' from here or anywhere else are going to effectively help you in your defense, other than the advice [if not already too late] to exercise the 5th Amendment right to SHUT UP and do NOT talk to police or ANYONE about the case except an attorney. That includes on this or any other web site or public forum. Most police and prosecutors will happily tell you that 95% of people convict themselves by trying to be 'helpful and cooperative', either during initial contact, questioning, interview or interrogation. If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me.
There is not much I can add to these already great answers other than to say most people talk themselves into to jail not out of jail. Get a lawyer and help him help you. Do not speak to the authorities about this case without your lawyer present.
