Legal Question in Criminal Law in California

My sons ex-wife has my 6 year old grandson in a home daycare and refuses to remove him. My son has requested he be removed because of numerous A and B violations that have been written up by community care licensing. The last violation was the owner was transporting my grandson from elementary school to her home and not placing him in a carseat or booster seat. Owner stated to Licensing that she was unaware of the carseat law that has been in effect since 2015 that states a child 8 years or 57 inches tall must be secured in carseat. Can my son, who is the Father with 50/50 legal and physical custody pursue a lawsuit against the home daycare for child endangerment? If so what are the options

These are not 'criminal law' questions. He should be discussing them with a divorce and custody attorney. If he elects to pursue civil litigation against the provider, assuming he has legal grounds to do so, expect to invest significant money in attorney fees and costs.
