statute on DUI filings

My son was arrested at a road check for DUI in California. Court date today -- court clerk informs his attorney that no case was filed. Attorney tells my son that that may or may not file...to move forward with his plans to move back home (IL).

Is this OK?

How long does CA have to file - arrest date is 12/24.

Can he get a license in IL?

what should we be doing?

If no case is pending against your son, you should listen to your attorneys advice. If you have additional questions, you should call your attorney and pose them to him/her.

Sure, he can move or travel as he pleases, but when the court sets a date for his arraignment, he'd better be there or there will be an arrest warrant issued. Provide the court and DA with proper address contact information or he won't get the letter they send notifying him of the date.
