YOU can try to file anytime you like. The prosecutor has somewhere between three and seven years to file or refile, depending upon the actual penal code charged. .

You are going to have to be more specific on the charges, and any enhancement. That's because there are several different statutes for kidnapping (without even mentioning federal charges) that have different penalties.
The general statutory outline for limitations of criminal actions is set forth in Penal Code section 799, and the sections that follow.
