Legal Question in Criminal Law in California

I am in a partner buiss.the partner, offerd to get a housing loan through her tribe.She is an american indian,The loan was to buy a house in Klamath Falls Oregon.The loan was for 399,000.I had to put down the difrance.So i put in 41,000 dollers.I pulled out from buying this home and was told that it would take up to 45 days to get me my deposit back.Well to say the least I am getting the run around and no money back.I am fully scard that I have been robbed and will never see this money again.she runs our restrant in Oregon and I am scard she is gonna take off.I really don't know what to do.I have called the Tribe to get answers but they told me to get a lawer.Can some one please help me.
