Legal Question in Criminal Law in California

stole a wireless mouse at walmart and got caught by under cover. value $40 i also have 1 prior from 5 years ago (felony did 8 months) i now want to request for probation for this case. what are my chances? i don't want to do time. i have a full time job. been at this job for 4 years now. i am also a single father and my daughter needs me. she is 4 years old and she is not on any government program (welfare, food stamp, medicare, etc...) what are my chances?

I would highly recommend that you consult an experienced attorney in your area. Since this is your second incident, you will be asking a lot of the Court to stay out of jail. The personal facts of your circumstances will not have a lot of effect unless they are presented correctly.
