Legal Question in Criminal Law in California

Strong Arm Robbery

My 19 year old son was arrested for Strong arm robbery, threats of violence and brandishing a knife and is being held in jail with a $42,500 bail. He did not do it! It was some friends of his who called the cops after they had all been parting. They told the police that my son let himself into their house, stole $40.00 out of his wallet, and then put a knife to another guys chest. They now are charging him with 2 felonies and 1 misdemeanor. He has never been in trouble with the law. If he ends up being convicted for these because we cant prove his innocence, what could he be facing?

Re: Strong Arm Robbery

How do you know he didn't do it? You weren't there, and I bet you haven't read the police report (which will become available at the first court hearing). Meantime, you need to get him a good lawyer (not the public defender). He could go to prison for several years if convicted. The burden is on the prosecution to prove he is guilty beyond a reasonable doubt, he does not have to "prove his innocence."

Re: Strong Arm Robbery

Hello---Thank you for your question. Your son is most likely to face the Major Felonies of Burglary and Strong Arm Robbery, and possibly lesser charges of Assault (possibly ADW--Assault with a Deadly Weapon). He is at the least in danger of going to prison for 10 years or more based on your info and my experience in what the DA will probably charge. You say that he did not do it, then he needs an aggressive Criminal Defense Attorney with great skill and experience. You may phone me to discuss further at (562) 754-7422, or email me. I have over 27 years of criminal defense experience, and I can help him. Attorney Woodworth
