Legal Question in Criminal Law in California

can you sue the police dept or the jail if you have been arrested for a crime you did not do? and spent over 6+ days in jail?

Yes you can sue them, however you should be very rich to sue them because the amount of money that can collect will pale in comparison to the amount that you would spend to sue them. I am talking about $65,000 to sue to collect about $1,500. It really does not make sense to sue them for that.

You can sue, but you will only be able to win if you can show that the authorities actually knew you were innocent, or at least that they had no reason to believe you were guilty. Police sometimes arrest people as a result of an honest mistake. The arrestees cannot sue successfully on that basis.
