Legal Question in Criminal Law in California
a suspect in accident
my son witnessed a solo motorcycle accident. The motorist was racing and lost control and flipped. He is on life support. my son saw the accident through his rear view mirror so he turned around to see if he could get help and offer himself as a witness. Now they are looking at him as a suspect. they called him to station and interrogated him for 2 hours hoping to break him and for him to confess. he insisted he had nothing to do with the crash. police said that there are witnesses that saw my son racing and other false accusations. my son stuck to his story. Before they let him go, they told him since he didnt confess he will be receiving in the mail either a warrant for his arrest or to appear in court. we are concerned. should we hire a lawyer to defend him even though he did nothing wrong? were they just trying to intimidate him? we are living each day in a stress not knowing what is going to happen. my son has clean record, and very loved by neighborhood. what should we do. should we just wait?

This is potentially a serious matter and you should hire a lawyer who at the very least will put a stop to all of police' tricks and intimidation. The police story that your son could avoid being arrested if he confesses is a bunch of BS.

Of course your son needs a lawyer. The idea that he doesn't need one because he is innocent does not make much sense. If the authorities believe he is guilty he needs a lawyer regardless of whether they are right or wrong. He may have already made damaging statements during his interview with the police, and he is likely to keep doing so unless he has competent defense counsel representing him.

Well, you can either sit there and wait to see what happens and then hire an attorney to defend him after they bring criminal charges against him, or you can hire an attorney now to intervene and try to 'influence' the proceedings on the assumption that the police accurately informed you of what they planned on doing. Feel free to contact me for the legal help you're going to need, if you get serious about taking action, if the case is in SoCal.
