Legal Question in Criminal Law in California
threats in text message and phone calls
What could I do about someone making threats towards me over the phone. He has said things like, ''the next time I see you, im going to kick the sh*t out of you'', ''Im gonna put you in the hospital'', ''im gonna kill you''.
And the text messages say:
1. Drop on site, ''my name''
2. I'm gonna cut you

file a complaint with the police.

You can call the police and file a complaint.
The District Attorney may file criminal charges against that person.
You can also file for a Temporary Restaining Order (TRO) against that person in civil court. A court date will be set for both sides to present evidence and the judge will then decide to either set aside the TRO or put a regular restraining order into effect.
Best of luck!
