Legal Question in Criminal Law in California

I got a ticket in CA for driving with a suspended CA driver's license but I gave the officer my valid AZ license. I live part time in both state with the majority of my time in CA. The officer said I am not allowed to drive in CA until my CA license is valid - is this true?

It is most likely true that you can't drive in California if your California license was suspended. It is my understanding that a person can't have driver's license in two different states. Most driver license applications request information regarding driving status in any other state (i.e. AZ is not going to issue a license to someone whose license is suspended in CA).

If someone were quick enough and knew that his license was going to be suspended in CA he could possibly scoot over to AZ and get a license before the CA suspension took place. Technically, he could probably even truthfully fill out the AZ application. The State of California is not, however, going to let him get away with these shenanigans.

If the person had an AZ license and than got a CA license the AZ would have been invalidated. The person should probably double-check the status of the AZ license.

Yes. California has suspended your driving privileges, at least within the state.

The effect of such a suspension should be nationwide since, as Mr. Kane notes, you should be able to get a license from only one state at a time. One of your licenses is probably invalid, since you probably made false statements on your application in order to get it.

Of course. Your CA driving 'privilege' is suspended, period. You commit a misdemeanor crime if you drive here, regardless of any other license you may have. You face a misdemeanor if the DA chooses to file your 'ticket' [arrest record] that way. BTW all other states will issue suspension or revocation of their license when they learn of the CA suspension. And they will learn.

It is illegal to possess a license from any state other than your official residence state, and illegal to drive with an out of state license for more than 10 days once you take up residence in CA. You can't have two residence states.

You don't get to game the system by hiding your CA license suspension from police with a foreign license. Get caught, get arrested.
