Legal Question in Criminal Law in California

If i go to trial

I am charged with 487(a) pc m

11550(a) hs m 11364 hs m. They offered me diversion for the drug charges but the theft charge the want to give me 45 days in jail. I have no preveous record. I didn't steal anything so thats the reason why i want to take it to trial. Also i'm attending real estate school and i can't get my license if the theft charge is on my record. My question is if i take it to trial and loose the drug charges because i am giulty of the under the influence will the still give me diversion?

Nope. Your choices are to cut a deal now, or take your chances at trial with mandatory sentencing and jail if you lose.
