Legal Question in Criminal Law in California
i"m in the trial stage in court the D A wants to give me life, my lawyer hasn't spoke to me or returned my calls i feel that he doesn't really care and i'm gonna get thrown under the bus on this can i still file a marsten motion?

The quesion is never, "Can I file?" its, "Will the judge grant..." It is a "Marsden" motion, and you can file it, but up to the judge to determine wheter to grant or not.
