Trouble?
If I have a charge filed against me by law enforcement can getting a lawyer prior to the charge help me in keeping any charges being filed? I am a bartender and I was fired from my last nightclub for taking from the til (no witnesses, no video, just computer reports implicating me!) Yes, the police were called in after I was fired to investigate. Still ongoing I think! I really want to minimize this as much as I can! Will the lawyer I choose then call the police to find out whats going on? Then let the police know I am not gonna talk with them if they approach me or call me? But if the charges are filed against me and I could be arrested is it to my benefit to surrender if I have to? Will this then show that I should have affordable bail so that I can continue with my life while cooperating? And not have to spend more than one day in jail after surrendering? Or maybe no bail at all and released because I have shown that I will not dissapear and miss any possible court dates. Maybe my lawyer negotiate with the powers that be to lessen what may be a felony to a lesser charge or no charge at all and me working something out to pay restitution (while not admitting guilt!)??? I have never been arrested so its kinda scary to me.

All of the things that you have suggested in your email are very doable. The most important reason to obtain legal representation at this, the pre-file portion of the case is that sometimes your attorney can make the difference between a criminal filing or a money compromise to make this go away. You correctly answered your own question. Yes, an attorney acting quickly may be able to minimize the problems you face, and may be able to get your case, if any, handled without you having to pay high bail. To answer your questions, many attorneys will take the lead in protecting you by contacting the police detective investigating the case, and obtaining information regarding the status of the investigation. A civil compromise, or negotiated payback of the amount alleged, can also be arranged, which may help you later if the police file a report for prosecution.
If a case is filed, you can surrender (preferably with a bail bondsman, who can release you immediately), or see a judge and argue lower bail.
I think that at least meeting with an attorney will ease your mind as to what you can expect, what your options are, and educate you as to how best handle this.
