Vandalism

My botfriend is charged w/ (PC594) Vandalism and (PC 242) Battery. I've bailed him out and his next court date is next week. Can you please tell us what kind of jail time, if any, he might be facing if he loses his case? Thankyou.

The 242 batter has a maximum penalty of 6 months in county jail and / or a fine upto $2,000. Each fine also has a penalty assessment of 175%

Vandalism has a penalty of up to 12 months county jail or 3 years in state prison, depending upon the amount of the damage. If the value of the damaged property exceeds $10,000 the fine can be up to $50,000 plus penalty assessment.

As another attorney noted, these type of misdemeanor offenses carry maximum penalties of 6-12 months in jail, up to $10,000 fines and restitution to the victim(s). The likely sentence if he is found guilty or pleads guilty depends on how outrageous his conduct was, the strength of the evidence against him, his prior criminal record if any, and, most important, whether or not he has a good lawyer.

Up to several years max under extreme circumstances. More likely some time plus fines. Sounds like he should hire counsel to keep the penalties to a reasonable level, or take it to trial if he wants. Contact me if interested in doing so.
