If someone promised to make payments on a vehicle and I am the lienholder can i call the police for driving a stolen car.

Falling behind on payments is generally not considered theft unless the person never intended to make any payments and entered into the transaction with you with a fraudulent intent to defraud. You have the right to recover the car. Not much else I am afraid.

I agree with Mr. Lentz. Unless this person intended *at the time he contracted with you* not to make the promised payments, this is a simple breach of contract case. In other words, it is a civil matter and not a criminal one.

You can try, but you'll probably have to sue instead.
