Legal Question in Criminal Law in California
I'm I a victim of a hit and run?
This morning as my son and I were crossing the street a car hit us. The driver stopped to to see if we we're okay and spoke to us briefly. I asked to see his license or insurance information but he claimed that he didn't have it with him. As I wrote down his license plate number and told him that I would call the police he drove off. Unfortunately I wasn't unable to call the police until 2 hours later and a report was made. My question is what actions can I take and do I have a case.

If either of you are injured and incur medical bills, and if the license plate can be traced to an owner/driver, then you can take legal action against him/them. Not having the drivers license suggests he had none, which would mean he has no insurance. If it's an old, inexpensive car, it suggests he has no money/assets. Try to get the police to trace the plate to an owner/driver. Feel free to contact me if interested in pursuing.

I'm sorry this happened to you and your child. If you were injured, even slightly, seek medical attention immediately! Then call an attorney in your area to help you get monetary compensation for your injuries. Please do these things right away. I hope you are feeling better, and that you have a safe and otherwise pleasant holiday. Please also do not discuss the accident with anybody except the police and your own attorney. Good luck.
