Legal Question in Criminal Law in California
Violent felonies
My brother was convicted of a assault w/ deadly weapon with (GBI). He was sentence to 1 year county jail and 3 years formal adult probation. He completed both jail and probation succesfully. he received 1 strike for the assault, my question is... can he get that felony expunged from his record? This was his first offense..

Re: Violent felonies
It's possible a lawyer can 1) get the felony reduced to a misdemeanor (because he didn't do state prison time) and 2) then get the misdemeanor expunged.

Re: Violent felonies
It may be possible to do in a couple steps by Motions, as long as he wasn't sentenced to or served prison time. Feel free to contact me if serious about pursuing, to discuss the facts and costs.
