Legal Question in Criminal Law in California
please help....
I was at walmart using the bathroom and forgot to zip my pants up properly because my wife called. I immediately firgure out this and fixed myself however, a lady called the police, and I was detained, asked my name and where I lived, hand cuffed, stuck in the back of their car and then taken to the police station where I was then read my rights, stuck in a room and was interrogated because they didn't believe me that I just forgot to zip up my pants, they said something about they had me on tape. I wasn't allowed to call anyone. I was then released to the custody of the Marine Corps and given a citation and a court date. I was told that the DA's office will call me to ''plea bargain'' but I don't want this on my record. They also told me that they might have to register me as a sex offender and tell my three year old daughter. They confiscated my computer, which is my wifes, not mine and my phone to see if I had child pornography. I don't know what to do, I've never had a record and I just forgot to zip my pants. Can I get these charges dropped and off my record?

You need to fight these charges. You do not want a sex offense on your record especially if you are innocent. You need an effective lawyer.

On your court date, you are going to plead "Not Guilty". You are entitled to a copy of all evidence, including the alleged tape to review before you agree to any plea bargain. Note that it is common practice for the DA to charge you with more than he really suspects he can convict you of, so do not be surprised if the charges seem rather extreme. If your version of the facts can be proved, then you have not committed any crime. But be advised that there are many innocent people in jail; so you should hire an agressive attorney who will not let the DA bowl you over.

There is no 'magic wand' to make this disappear, only good legal defense. You'll have to vigorously defend yourself against the charges, using whatever defenses and arguments are available. You appear not to realize the reality of how serious the prosecutor is in pursuing this, and what you've been told - tape evidence that the police and prosecutor reviewed before filing charges.
