i have a warrant in california and i a in mexico and i now want to return to do my time but i had a son here in mexico will i be arrested going into the embassy for his papers?

Normally, to properly handle a warrant, you must turn yourself into the court issuing the warrant, with or without an attorney, and try to negotiate a recall of the warrant and a plea bargain on the �Failure to Appear� charge, negotiate bail or OR release, and then negotiate or take to trial any outstanding charges that caused the warrant. However, you indicate you face known jail time, which implies that you have already been convicted or entered a plea bargain, but fled before turning yourself into jail. You will be arrested if you come in contact with law enforcement or customs anywhere in the US, but probably not at the embassy outside the US. IF you could get into the US without arrest at the border, then you can turn yourself in, as described. Doing so voluntarily will result in a better outcome than being brought in cuffs to court after arrest on the warrant. Your attorney may be able to work out an arrangement with the court and prosecutor to allow a voluntary turn in.

Which embassy? The US embassy in Mexico? The Mexican embassy? What is the warrant for? Do you understand you have a new charge of failure to appear? So no matter how much time you HAD facing you, if it was a misdo, you now have a new misdo case. If you were guilty of a felony, you have a new felony case. You need a lawyer, not advice.
