Legal Question in Criminal Law in California
Weapon Found After Arraignment
A weapon was found in an impounded vehicle apporoximately 7 days after my arraignment hearing. It was found by an employee at the impound yard and given to the police department. The vehicle is not registered in my name. Can I be charged with possession of an illegal firearm?

Re: Weapon Found After Arraignment
They can always charge you with anything. It is their burden to prove that you possessed the weapon, and that it had some other characteristic making its possession in a vehicle illegal.

Can you be? Sure. Can they win? Depends on all the facts and evidence. Hire an attorney.
