Legal Question in Criminal Law in California
WIC section 8103(f) Relief from Firearms Prohibition
I recently 5150'd myself and was held for 72 hours at a local mental health facility. (no firearms were involved). I have requested a hearing to restore my right to own a gun.
I have a letter from my psychiatrist stating that I am no threat either to myself or others and should have this five year ban lifted.
I can find very little information on the internet regarding this matter. He informed me that the judge rarely overturnes this type of request.
Can you tell me what my chances are, and what types of questions will be asked during the hearing?

Depends upon the court, the larger ones will usually have you interviewed about the incident by someone from mental health, to make sure you're really normal and safe. Your shrink's letter is the primary evidence, it better be thorough and strong.
