As a Misdemeanor, PC 415 can carry up to six months in jail. However, I have never had PC 415 case that has resulted in jail time.

What will happen in your case will depend on the facts of the situation as well as the Court you are in front of. You need to be prepared to put up a vigorous defense.

I agree with Mr. Polston. Your best bet is to be prepared for your next hearing. If you haven't been appointed a public defender (this depends on your ability to pay for an attorney) I would suggest you get good legal representation. Please let me know if you would like to discuss your case further.

The outcome of the case will be decided by the DA, judge and your attorney in negotiations, or by a jury at trial. If no priors, yes, then you can hope for a combination of fines, probation, anger management classes, etc. If serious about getting counsel to maximize your chances, feel free to contact me.
