It is a misdemeanor crime with potentially up to 6 months in jail and referral for deportation. If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me.
If you cannot afford an attorney, one will be appointed to represent you. But in any case you must have an attorney. Be honest with the attorney. Try to get it reduced to an infraction. But in any case try to avoid jail either by doing community service or some other alternative to jail. If you end up in jail you could be deported. Make sure you make your court dates. Otherwise a bench warrant will be issued and you will be arrested with possible deportation.Make sure you do not drive any more. If you are arrested a second or a third time the chances of jail increase and with incarceration increased chances of deportation.
