Legal Question in Criminal Law in California

Will Warrants Affect Travel?

Hello,

I just found out that I will have to travel internationally in June, coincidentally, I have just learned that I have four warrants for misdemeanor offenses in the system dating back to 1995. One is for failure to appear on a simple assault sentencing (I plead guilty and thought I was given time served), the other three are for annoying phone calls-parenthetically, I was suffering from a very rare bout of bipolar disorder during these occurences and thought these charges had been dropped since- I would like to plead insanity if expedient, much documentation exists.

Here's my question, I'm concerned that if I travel, these warrants might pop up- while I've traveled extensively for years since, perhaps the checks are more extensive now.

I'm starting a job April 1 and I want to handle these matters now, but don't want to end up in jail inadvertently and lose the job-if I ask the PD to pursue trial based on the above criteria, could I resolve these matters by 4/1-I think all of the putative parties have moved out of state also-perhaps summary dismissal is possible.

Thank you for your assistance.

"Might pop up?" I virtually guarantee you will be arrested upon returning through US customs, if not upon check-in for departure. You need to get these resolved immediately. You should also consider and and deal with the problem of the new job not knowing of the arrests. If these are cases in the Souther California area, I will be glad to help you. Contact me if interested.

Depending on the charges and how old they are, you may be able to just show up, turn yourself in, and resolve them all at the same time. I recently helped two clients with criminal matters that were quite old. Feel free to call my cell phone if you have any questions.

Good luck,

Re: Will Warrants Affect Travel?

I completely agree with the lawyer who said that your arrest is almost certain, but I don't agree with the other response that said you might just be able to turn yourself in on all 4 matters and wrap it up, neat and tidy, just like that. I've been practicing for 30 years in LA County, and I can almost assure you (though nothing is impossible) that it will not be so quick and easy, unless you're just willing to take the jail sentence that is almost assuredly waiting for you in the old assault case, at a minimum. You're on probation in that case, you get sentenced and you don't show up for jail? You're dreaming if you think they'll just dismiss that one. The others would take a couple of months to resolve, maybe longer, but a lot depends on which courts they're in, and many other factors now known here. And you're thinking of interjecting an insanity defense??? Figure that'll take at least a year to resolve. Maybe more. Not to mention the serious downsides to an insanity defense that you haven't even considered yet. April 1 is two weeks away. A nanosecond in the criminal justice system. If you'd like a free consultation with me to discuss these things in more detail, please don't hesitate to call me at 310 393 0639. Steve Mandell, Attorney at Law

Re: Will Warrants Affect Travel?

Thank you for your inquiry.

You truly should clear this up before you plan international travel. Although with misdemeanors you may not be taken into custody, you certainly run the high risk that you will be detained, held, transferred and then sentenced as a fugitive, which can result in high penalties from the cases you've described.

I hope that this information helps, but if you have other questions you need answered, need more information, or feel that you need legal representation, please feel free to email me directly at [email protected]. Im happy to help in any way that I can.
