Legal Question in Criminal Law in California

willful cruelty to child

I was charge of wilful curelty to child

I went to the store stole make up and put in my daughter purse. Then later I was arrested stay in jail for 3 days and 3 nights. I've learned my lesson. I've never been in jail before. I've got released in there from O.R. and tomorrow I have to go to court. Can you give me an advice? It's a misdemeanor.

They did not charge me petty theft.

Do NOT plead to that charge. You will live with that on your record the REST OF YOUR LIFE. I believe a good attorney may be able to get the prosecutor to get the charge changed. Seek legal advice. My office has done 100's of your type of case. Seek out a Former D.A.like myself. Make sure the attorney has a history of doing these kinds of matters. I wish you well. David Wallin.

Based upon the facts you have provided, I don't see how that charge can stick. You may end up being convicted of something else (that you haven't been charged yet re the petty theft does not mean it won't happen), but it's important that you beat this particular charge if at all possible. You need a lawyer asap.

Good luck.

You may have 'learned your lesson', but you still face serious penalties in court. Get an attorney. If you can't afford private counsel, apply for the Public Defender. Feel free to contact me if serious about getting counsel.
