Legal Question in Criminal Law in California
withdraw guilty plea
My cousin fell for the oldest trick in the book and was told by pleading guilty she would be released. This case involved 5 individuals, all over 18 except my cousin who is 17 but will be 18 next month. They are all innocent.. they did not do the crime. She plead guilty yesterday and was released but found out that the others are being charged again with the same charges and brought back to jail.. what should she do?

Re: withdraw guilty plea
Stand up and take her punishment like a man, she already agreed to it. Innocent people don't plead guilty, or shouldn't. As long as the court sentences her to the agreed punishment, she has nothing to complain of. If the court doesn't, then she probably can withdraw her plea and go to trial with all its risks. Sounds like the others are also going to have to make the same decisions as she did.
