wobbler conviction and probation termination

My son has served 1/2 of his 3 yr probation period sentence on a ''Conspiracy to dissuade a witness'' wobbler felony. He's completed every other condition as well. His attorney(who is too busy to ever get back to us) said he thought it was too early to go back to court and ask probation to be terminated but we're sure the prob. officers said he could. Also, can we have the wobbler turned into a misdemeaner at the same time? When can we get the misdemeanor expunged and do we go to court for that? Thank you so much for your time.

Halfway into probation is a perfect time to ask for termination of formal probation and reduction to misdemeanor. This should be done with a single motion at the same time. If successful, you then might ask during the same proceeding for immediate expungement. The judge would either grant the expungement or keep your son on misdemeanor/summary probation for another 1 1/2 years or so. You could then ask again for expungement at the end of summary probation.
