Legal Question in Criminal Law in California
Can I work in childcare with one 5+ year old violent felony charge that is expunged under pc.1203.4?
1 Answer from Attorneys
Expungement did NOT remove that from your record, and applications for workers in childcare, medical /nursing care, finance/banking, security clearances, and others, all require you fully disclose ALL criminal history, expunged or not. They will see it in their background check, and your failure to disclose will result in 'application fraud' and rejection of your application. The employer and licensing agency involved will determine if the nature and extent of your criminal history bars you from the position you want'. Contact the appropriate licensing agency or the prospective employer to discuss your situation. You don't need an attorney for this.
