Legal Question in Discrimination Law in California

I have a friend that is 18 still in high school, he has a girlfriend that is 16. The parents left these two alone and didnt come back until 2 to 3 a.m and found them having sexual relations would this kid be charged for anything even though the parents gave them permission to be together?

Yes. It is called statutory rape.
