Legal Question in Discrimination Law in California
Gender Discrimination
My female boss has had a history of either firing men before their 1 yr. probationary period or treating them so badly that they'd quit after about 18 months. I was treated differently than my 2 female co-workers. My boss was on very friendly terms with them, but ignored me. My performance eval's were satisfactory up until 3 weeks prior to my 1 year anniv. when I contradicted something she said in front of other employees at a staff meeting. After that, she released me from probation a few days prior to my one year anniv. even though I did or was in the process of doing everything my boss asked me to do. The union agreement requires monthly evaluations, but my boss only did 3 eval's. I filed a discrimination complaint with the HR Depart. and Union about 1 1/2 months ago when I was released from probation, but they still haven't conducted any interviews with any employees, even though I told HR that several current employees are willing to be witnesses. The Discrimination Policy indicates that they are supposed to immediately investigate discrimation charges, but it seems like they are dragging their feet. What is a reasonable length of time to carry out a discrimination complaint investigation? How should I proceed?

Re: Gender Discrimination
Your union is your primary remedy for all claims against the employer. However, IF you can clearly demonstrate gender discrimination, you could pursue such claim through your own attorney.
