If a tenant leaves a disturbing sexual harassment, threatening and racial voicemail, can I fail a civil lawsuit?

That woud depend entirely on what exactly was said and the full context of the message. If you are asking if you can sue for money damages, however, the answer is almost certainly, "no," because you have no money damages from it. You may be able to evict them, and you may be able to get a restraining order, but the situation you describe does not qualify for a traditional civil lawsuit for money.
Threats and harassment are crimes, so you could file criminal charges with local police, or you could file a lawsuit . Both require proof and admissible evidence.
