Those are both misdemeanor charges carrying a 6 month sentence each. Although you can be convicted of both, you can only be sentenced for one (under most circumstances).

DUI becomes a felony if the driver has injured someone while DUI.

No. However other circumstances can lead to either a 23153 a/b or other charges. I have seen a simple DUI change to assault and battery due to the defendants behavior at the arrest.
