Legal Question in DUI Law in California
3 DUIs in less than 2 months. No probation, no injury, nothing prior. I spent 3 months in rehab and 3 months sober so after 6 months now the best offer I am getting is 9 months of inpatient rehab which costs 10k a month. Everyone I talk to says this is one of the worst judgments. I accepted this being told I can work but now I am told I have to pay around 10k a month for rehab and cannot even work for 9 months. Can I fire my attorney now and try to work something else out? How in the world can anyone afford 9 months of impatient treatment?

Trying to undo a deal is not easy. Don't let lawyers tell you otherwise just to get you to pay them money. It's not impossible and we have handled many cases like yours. Each case rises and falls on it's own merits. We would have to have a good reason to modify the sentence and we would have to get the D.A. and the judge on board. Yes, you can replace your attorney.
Yes, he can go back to court and TRY to get the order changed.
That is not a guarantee that it will succeed, as he will have to convince the judge there are valid grounds to make such change after you agreed to the original sentence in order to to avoid jail.
